They say Data is the ‘new oil’. It is a finite and highly valuable resource and how it is managed determines whether organizations can leverage this resource to drive innovation, growth, and revenue. Due to the importance of data, the legal and regulatory environment around data protection and privacy has significantly evolved over the last few years, especially in Africa.

In Kenya and other African countries, new laws and regulations have come into place thrusting organizations at the forefront of data and privacy issues they hitherto never had to deal with or to which they gave scant attention. The Firm has developed and deploys capacity in this area by providing advice, training, and, through a consultancy-based approach working with partners, advice on big data and cyber security.

This is in recognition that data and privacy matters go beyond law and to be effective one has to approach the issues from a multidisciplinary angle. With specialist data protection and privacy practitioners, the Firm offers the following services, among others:

  • Developing data protection and privacy strategies and compliance matrix;
  • Providing Data Protection Officer (DPO) service;
  • Risk analysis with respect to data and privacy;
  • Data protection risk impact assessment;
  • Developing institutional data protection and privacy guides;
  • Developing institutional data protection policies, privacy notices
    and checklists;
  • Developing data protection and privacy-related clauses in agreements for
    staff, contractors, agents, suppliers etc;
  • Developing data processing and transfer agreements;
  • Advising on privacy aspects of investigations and e-discovery;
  • Representation in relation to complaints with the Data Commissioner or
    disputes in courts; and
  • Training and awareness.

In the Corporate legal space, we act for local and international corporations as well as other forms of businesses in various sectors and fields, including aviation, broadcasting, healthcare and pharmaceuticals, infrastructure, insurance, and telecommunications. We also offer advisory services in relation to capital markets, including public listing, privatization, public-private partnerships (PPPs), and corporate restructuring.

Finally, in our corporate practice, we also offer advisory services on corporate governance and act as company secretaries. Our Government Relations and public policy practitioners represent companies, non-profit organizations, and other entities with issues relating to national, county, and local laws, regulations, and policies.

We help give the clients a voice in the National Assembly, the Senate, and in County Assemblies as well as having their voices heard by the executive branches at both the national and county levels impacting the direction of legislative and policy changes to align with clients business strategies. We also support clients to be heard in standard-setting regional and international bodies and organizations.

Through education, advocacy, and networking, we ensure that clients’ grievances are heard so that legislative or policy proposals as well as regional and international standards may be advanced or modified or stopped if the same adversely affect the client’s business strategy and long-term goals.

Our Data, Corporate, and Government Relations Practice Group is led by Mr. Mutua Mutuku as the Team Leader. The other team members in the practice are Sisule Musungu, Chege Waitara, Andrew Mwango, and Wangechi Wahome.
